TERMS AND CONDITIONS

In this contract we use the terms "Urban Technology", "we", "our", and "us" to refer to Urban Technology and "you" and "your" to refer to the customer. Headings in this contract do not affect their interpretation.

Privacy Policy

All personal information submitted to Urban Technology for billing and record keeping purposes in the processing of any orders, including, but not limited to credit card and other personal information, will be kept strictly confidential and used solely for internal purposes by Urban Technology.

We agree not to sell, rent, share or release this information to any other individual, entity or third party, for any reason, without the specific written consent of the Customer; with exception as required by law, regulation or governmental authority.

In some circumstances, you may voluntarily provide personal information in response to a form on the site or other contact method. Unless explicit permission is granted by the person providing the information, this information will also only be used for internal purposes.

Billing Policy

You agree that you will:
(a) Pay for all goods and services to you. We are currently non GST registered.
(b) Pay each bill by the due date for payment set out in it. If you do not we may charge you a late fee of $7.50 per month on the overdue amount from the due date until payment of the relevant amount and we may also recover from you all legal and related collection costs incurred by us arising from the collection of any amount which you owe to us and which you do not pay to us then due.

We reserve the right to refuse service to any person or entity who applies to use our service. Reasons for refusal may include but is not limited to unfavorable credit rating, notification of bankruptcy, liquidation, business closure, criminal or unfair trading practices.

Urban Technology has three payment options:
1. Cheque
2. Internet Banking

Payment by Cheque or Internet Banking on Invoice
Invoices are issued every 10th of the month and due each 20th.

Should a due date fall on a weekend on public holiday your invoice will be due next business day.

Failure to pay your invoice by your due date may result in suspension of all your services you hold with us, including re-taking control of any domains you have with us, until full payment is received, or a suitable arrangement has been made with Urban Technology during regular 9–5 business hours.

Closing an Account
You may close your account by sending an email to accounts@urbantechnology.co.nz. The request must meet the following criteria:

Include your account information (domain name and name of authorized contact for website).

Accounts MUST BE paid up to date before we terminate your account with Urban Technology. If you are unsure about your balance, please contact Urban Technology.

Accounts that are cancelled within the 30 day guarantee, will received back their prepaid hosting fees in full.

Requests to cancel accounts or the termination of your payment plan at Urban Technology will result in the IMMEDIATE deactivation of your account.

On termination or expiry of this agreement for any reason, Urban Technology may delete all Client Data from any storage media. Ending the contract between us in this way shall not release you from any outstanding obligations or responsibilities you owe to us.

Warranties and Liabilities -

The Client warrants that it will keep secure any passwords used to upload data to the Server.
The Client warrants that all data uploaded onto the server under this agreement will not expose Urban Technology to the risk of any claim, legal or administrative action or prosecution.
Urban Technology reserves the right (but is under no obligation) to remove from Internet Access any part of the Client Data that in Urban Technology's opinion, infringes any of the warranties set out in this agreement.
Urban Technology has no obligation to review or edit content of the Client Data.
The Client is solely responsible for dealing with persons who access the Client Data, and must not refer complaints or inquiries in relation to the Client Data to Urban Technology.

All information sent to us by the you to be used on the website, whether it be photos, logo’s, art designs etc are your responsibility in regards to copyright issues and Urban Technology will not be held accountable or liable in any disputes stating otherwise.

Urban Technology may pass on any material or information it finds as a result to the relevant authority if Urban Technology suspects any illegal or offensive activity is involved, and you will have no claim against Urban Technology for this.

We shall not be liable to you for any loss or damage directly or indirectly arising out of or in connection with any delay in delivery of the goods or failure to perform its obligations under this Agreement where such delay is caused directly or indirectly by an act of God, armed conflict, labor dispute, civil commotion, intervention of a government, inability to obtain labor, materials or manufacturing facilities, accidents, interruptions of, or delay in, transportation or any other cause beyond our control.

Termination:
Urban Technology may terminate the Service for any reason by giving The Customer (7) days notice.
On termination or expiry of this agreement for any reason, Urban Technology may delete all Client Data from any storage media.

Registration Requirements
In consideration of the Use of the Service, Client certifies to Urban Technology that he/she is not a minor. By accepting this Agreement, you represent that you are at least 18 years of age.

You agree to provide Urban Technology with accurate, complete and up-to-date billing information, including your legal name, electronic mail (e-mail) address, home address, and telephone number. All changes to this information must be reported to Urban Technology within 30 days of the change.6.4 Urban Technology will communicate to you via your last known email address. It is the clients duty to inform us of any account changes, failure to do so may result in suspension/closure of your account due to unpaid accounts.

Urban Technology reserves the right to modify these terms and conditions at any time.
